These Terms of Service (“Terms”) govern your access to and use of www.dailot.us (the “Site”) and any purchases or services made available through the Site.

The Site is operated by Total Beads LLC, doing business as Dailot (“Dailot,” “we,” “us,” or “our”). Dailot offers this Site, including its information, tools, products, and services, subject to your acceptance of these Terms.

By visiting the Site, creating an account, or purchasing a product, you agree to these Terms and to the policies referenced in them. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old or the age of legal majority where you live to make a purchase through the Site.

If you permit a minor to use a product purchased from Dailot, you are responsible for supervising that use and ensuring that the product is appropriate and safe for the minor.

You may not use the Site or our products for any unlawful or unauthorized purpose.

2. Shopify

Our online store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to offer and sell products to you.

Your purchase is made from Total Beads LLC, not Shopify. Dailot is responsible for the products sold through the Site, order fulfillment, customer service, returns, and refunds.

Your use of certain Shopify features, including Shop or Shop Pay, may also be subject to Shopify’s consumer terms and privacy notices.

3. Products and Product Information

We make reasonable efforts to display product descriptions, colors, dimensions, quantities, materials, and images accurately.

However:

  • Colors may appear differently depending on your device or screen settings.

  • Product measurements and quantities may have minor variations unless expressly guaranteed.

  • Handmade, natural, dyed, plated, coated, or manufactured components may show variations in color, shape, texture, pattern, or finish.

  • Packaging may differ from what is shown on the Site.

  • Product availability is not guaranteed.

These variations are not necessarily defects.

We may modify product descriptions, prices, packaging, or availability at any time. We may also discontinue a product without notice.

4. Product Safety

Some products may contain small parts and may present a choking hazard. Unless a product listing expressly states otherwise, our products are not toys and are not intended for unsupervised use by children.

Customers are responsible for reviewing product descriptions, warnings, materials, measurements, and intended uses before purchasing or using a product.

Products should be used only for their intended purpose. Dailot is not responsible for harm caused by misuse, improper storage, unauthorized modification, or failure to follow applicable warnings or instructions.

If you have an allergy or sensitivity to a particular metal, coating, dye, adhesive, or other material, contact us before purchasing. Product information is not medical or professional advice.

5. Orders

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order, but it does not guarantee acceptance.

We may accept, reject, limit, or cancel an order for reasons including:

  • Product unavailability.

  • Pricing or product-description errors.

  • Suspected fraud or unauthorized activity.

  • Payment authorization problems.

  • Shipping restrictions.

  • Violation of these Terms.

  • Orders that appear to be placed by resellers or distributors without authorization.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method, subject to processing times outside our control.

Please review your shipping address, email address, order quantities, and product selections before submitting an order. Contact us promptly if you discover an error. We cannot guarantee that an order can be changed after it enters processing.

6. Prices, Payments and Taxes

Prices are displayed in the currency indicated during checkout. Unless otherwise stated, prices do not include applicable taxes, shipping costs, duties, brokerage charges, or import fees.

You agree to provide current, complete, and accurate billing and payment information.

Payments are processed by Shopify and the payment providers displayed during checkout. Dailot does not ordinarily receive or store complete payment-card numbers.

You authorize the applicable payment provider to charge the total displayed during checkout.

We may correct pricing, typographical, or calculation errors. If an error affects an order already submitted, we may contact you for instructions or cancel and refund the affected order.

7. Promotions and Discount Codes

Promotions and discount codes:

  • Are subject to their stated terms and expiration dates.

  • Have no cash value.

  • May not be combined unless expressly permitted.

  • May be limited to particular products, customers, or order values.

  • May be modified or discontinued as permitted by law.

  • May not be copied, sold, transferred, or used fraudulently.

If a promotion conflicts with these Terms, the specific promotion terms control for that promotion.

8. Shipping and Delivery

Dailot currently ships to eligible addresses in the United States and Canada.

Available shipping methods, estimated delivery times, and charges are displayed during checkout or described in our Shipping Policy.

Delivery dates are estimates unless expressly stated otherwise. Delivery may be affected by carrier operations, weather, customs, incorrect addresses, holidays, or other circumstances outside our reasonable control.

If we cannot ship within the promised time, we will provide any notice, cancellation option, or refund required by applicable law.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges caused by an incorrect address, refused delivery, or unclaimed package may be deducted from a refund where permitted by law.

Risk of loss and legal title transfer as provided by applicable law and the selected shipping terms.

9. Canadian Orders, Customs and Import Charges

Orders shipped to Canada may be subject to import duties, taxes, customs assessments, brokerage fees, or carrier charges.

Unless the checkout expressly states that these amounts are included, the recipient is responsible for paying them. These charges are imposed by government authorities, customs agencies, carriers, or brokers and are not controlled by Dailot.

Customers are responsible for ensuring that purchased products may lawfully be imported into and used in their destination.

Customs processing may delay delivery.

10. Returns and Refunds

Returns, exchanges, cancellations, damaged-item claims, and refunds are governed by our Refund Policy.

Please review that policy before purchasing. The Refund Policy is incorporated into these Terms.

Nothing in these Terms or the Refund Policy limits a non-waivable consumer right available under applicable law.

Refunds approved by Dailot are generally issued to the original payment method. Banks and payment providers may require additional time to post a refund.

11. Accounts

You may be able to create an account to manage orders or access certain Site features.

You are responsible for:

  • Providing accurate account information.

  • Keeping your login credentials confidential.

  • Restricting access to your account and devices.

  • Activities conducted through your account.

  • Informing us promptly of suspected unauthorized access.

We may suspend or terminate an account if we reasonably believe it has been compromised, used unlawfully, or used in violation of these Terms.

12. Reviews, Feedback and User Content

If you submit a review, photograph, comment, suggestion, or other content (“User Content”), you represent that:

  • You own or have permission to submit it.

  • It is accurate to the best of your knowledge.

  • It does not violate another person’s intellectual-property, privacy, publicity, or other rights.

  • It is not unlawful, deceptive, defamatory, threatening, obscene, or abusive.

  • It does not contain malware, spam, or unauthorized advertising.

You retain ownership of your User Content. By submitting it, you grant Dailot a nonexclusive, worldwide, royalty-free, transferable and sublicensable license to host, reproduce, display, format, and use it in connection with our Site, products, marketing, and business.

We may remove or decline to display User Content that violates these Terms or is otherwise inappropriate, subject to applicable law.

13. Intellectual Property

The Site and its content—including text, graphics, logos, photographs, product descriptions, designs, videos, page layouts, and software—are owned by or licensed to Total Beads LLC and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, lawful shopping purposes.

Without our prior written permission, you may not:

  • Copy, reproduce, modify, distribute, sell, or commercially exploit Site content.

  • Use Dailot’s name, branding, trademarks, or product images.

  • Scrape, mine, index, or systematically extract Site data.

  • Reverse engineer or interfere with Site software.

  • Remove copyright, trademark, or ownership notices.

14. Prohibited Uses

You may not use the Site:

  • For an unlawful, fraudulent, deceptive, or abusive purpose.

  • To violate intellectual-property, privacy, publicity, or other rights.

  • To submit false or misleading information.

  • To distribute malware or malicious code.

  • To collect information about other users without authorization.

  • To interfere with the Site’s security or operation.

  • To attempt unauthorized access to an account or system.

  • To evade purchase limits or abuse promotions.

  • To place fraudulent orders or initiate improper payment disputes.

  • To impersonate another person or entity.

  • To engage in automated scraping without written permission.

We may restrict or terminate access for conduct that violates these Terms.

15. Third-Party Services and Links

The Site may provide access to third-party services, payment providers, shipping carriers, applications, or websites.

We do not control and are not responsible for third-party services. Your use of them may be governed by separate terms and privacy policies.

A link or integration does not necessarily mean that Total Beads LLC endorses the third party.

16. Privacy

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.

Except for warranties expressly stated by Dailot or required by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

  • The Site will always be available, secure, or error-free.

  • Site information will always be complete or current.

  • Every product will meet every customer’s subjective expectations.

  • Minor variations in products will not occur.

Some jurisdictions do not permit certain warranty exclusions, so parts of this section may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, Total Beads LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, revenue, data, opportunity, or goodwill, arising from the Site, products, or Services.

To the fullest extent permitted by law, our total liability for a claim relating to a purchased product will not exceed the amount you paid for the product giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or certain personal injuries.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Total Beads LLC and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the Site.

  • Your material violation of these Terms.

  • Your infringement of another person’s rights.

  • User Content you submit.

This provision does not require you to indemnify Total Beads LLC for its own unlawful conduct.

20. Governing Law and Venue

These Terms and transactions with Total Beads LLC are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law principles.

Subject to any non-waivable consumer rights, legal proceedings arising from these Terms or the Services may be brought in the state or federal courts having jurisdiction in Wake County, North Carolina, and the parties consent to that jurisdiction.

If you are a Canadian consumer, this section does not deprive you of mandatory rights or remedies available under the laws of your province or territory.

21. Changes to the Services or Terms

We may update these Terms to reflect changes to our business, Site, products, practices, or legal obligations.

The updated Terms become effective when posted, unless another date is stated or applicable law requires additional notice.

Changes do not retroactively alter terms that applied to a completed purchase unless permitted by law.

We may modify, suspend, or discontinue all or part of the Site, subject to obligations concerning orders already accepted.

22. Severability

If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

23. No Waiver

A delay or failure by Dailot to enforce a provision does not waive our right to enforce it later.

24. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any other policies displayed during checkout, form the agreement between you and Total Beads LLC concerning the Site and purchases made through it.

If a product listing or promotion contains specific terms that conflict with these Terms, the more specific terms control for that product or promotion.
